This Privacy Policy describes how ContractorNerd Insurance Services, LLC, operating the BuildersRiskNerd marketing brand and buildersrisknerd.com, and any of its affiliates or subsidiary companies where applicable collectively, “ContractorNerd,” “BuildersRiskNerd,” “we,” “us,” or “our”, collect, use, disclose, and protect information when you access or use our websites, applications, quote forms, communications, and related services collectively, the “Services”.

ContractorNerd Insurance Services, LLC is a licensed producer. BuildersRiskNerd is a marketing brand and website operated by ContractorNerd Insurance Services, LLC. We act as a licensed insurance producer that helps individuals and businesses evaluate, obtain, and manage insurance coverage offered by insurance carriers. We are not an insurance carrier, and coverage is subject to carrier underwriting and approval.

By using the Services, you agree to the collection and use of information in accordance with this Privacy Policy.

This Privacy Policy applies to information we collect when you visit or use buildersrisknerd.com or related Services; request an insurance quote or submit an application through us; communicate with us by email, phone, chat, SMS/text, web form, or social media; attend events or seminars where ContractorNerd or BuildersRiskNerd is present; or otherwise interact with ContractorNerd or BuildersRiskNerd in connection with our Services.

This Privacy Policy does not apply to third-party websites, services, insurance carriers, wholesalers, managing general underwriters, program administrators, premium finance companies, or platforms that may link to or be accessible from our Services. Those third parties have their own privacy policies.

Interpretation and Definitions

Words with initial capitalization have meanings defined below. These definitions apply whether the terms appear in singular or plural.

Account means a unique account created for you to access parts of our Services.

Affiliate means an entity that controls, is controlled by, or is under common control with a party.

The information we collect depends on how you use our Services, such as browsing our website, requesting an insurance quote, applying for coverage, or receiving ongoing licensed producer services. We may collect the following categories of information.

A. Information You Provide to Us

Contact and account details: name, email address, phone number, mailing address, business name, account login credentials where applicable, and preferred contact method.

Business and professional details: job title, business classification, industry, contractor license information, certifications, years in business, ownership information, entity details, and related business identifiers.

Builder’s risk, construction, and insurance quote/application information: project address, project type, construction type, occupancy, estimated completed value, hard costs, soft costs, existing structure information, renovation details, project start and completion dates, lender or mortgagee information, owner information, contractor information, subcontractor information, permits, inspections, loss-control details, security protections, fire protections, prior insurance information, loss and claims history, requested limits, deductibles, endorsements, and other risk or underwriting information.

Government ID, tax, and verification details where needed: driver’s license or state ID, Social Security number, passport number, tax ID, FEIN/EIN, contractor license numbers, ownership information, or other identifiers as required for identity verification, fraud prevention, premium finance, carrier underwriting, compliance, or insurance placement.

Payment and transaction details where applicable: billing contact information, payment method information, transaction records, invoices, finance agreements, and related communications. We may use third-party processors, and we generally do not store full payment-card numbers on our systems.

Communications: information you provide when you contact us, including emails, chat messages, SMS/text messages, web forms, call notes, support requests, and social media messages. We may record calls where permitted by law and/or with appropriate notice.

B. Information Collected Automatically Online

When you use our Services, we may automatically collect:

Device and network data: IP address, device type, operating system, browser type, language preferences, referring URLs, and general location derived from IP address.

Usage data: pages viewed, links clicked, time spent, referring and exit pages, form progress, and other interaction data.

Session and interaction data: mouse movements, clicks, scrolling, page navigation, form interactions, heatmap data, and similar interaction or technical event data collected through analytics, session replay, and heatmapping tools where enabled.

As a licensed insurance producer, we may receive information from third parties in connection with providing our Services, including insurance carriers, underwriting platforms, wholesalers, managing general underwriters, program administrators, premium finance companies, inspection vendors, claims administrators, public sources, contractor licensing boards, business registries, industry databases, service providers, vendors supporting verification or fraud detection, your employer, your colleagues, your lender, your authorized representatives, or other parties involved in the requested insurance transaction.

We treat information received from you or third parties in accordance with this Privacy Policy.

2. How We Use the Information We Collect

We use information to operate our Services, provide licensed insurance producer services, and comply with legal obligations. This includes the following purposes.

A. Providing Licensed Insurance Producer Services

We use information to provide quotes, evaluate insurance options, assist with selecting coverage, submit quote requests and applications to insurance carriers and intermediaries on your behalf, place or bind coverage when authorized, service policies, process endorsements, prepare certificates of insurance, support renewals, assist with audits and inspections, support billing, and assist with claims reporting and communications where applicable.

B. Communicating With You

We use information to respond to requests, provide customer support, send quote status updates, policy documents, renewal reminders, billing communications, administrative notices, security notices, and marketing messages where permitted by law.

C. Compliance, Risk Management, and Security

We use information to verify identity, prevent fraud, conduct sanctions or compliance screening, comply with insurance, privacy, financial, and other legal obligations, protect the security and integrity of our Services, and enforce our agreements and policies.

D. Improving and Operating Our Business

We use information to analyze and improve our Services, user experience, content, workflows, insurance offerings, customer support, marketing, and internal operations. We may create aggregated or de-identified analytics where permitted by law.

E. Session Replay and Heatmap Data

We do not use session recordings, heatmaps, or similar behavioral analytics as the basis for underwriting, pricing, eligibility, or coverage determinations.

3. How We Disclose and Share Information

We do not sell personal information as “leads.” We disclose information only as necessary to provide our Services, comply with law, and operate our business.

A. Insurance Market Participants

We may disclose information to insurance carriers, insurers, reinsurers, underwriting platforms, wholesalers, managing general underwriters, program administrators, premium finance companies, inspection vendors, claims administrators, adjusters, and related insurance market participants. These disclosures are made to quote, underwrite, bind, administer, service, renew, audit, inspect, or support insurance coverage, or to assist with claims.

B. Service Providers and Vendors

We may share information with Service Providers that help us operate our business, such as website hosting, cloud storage, customer support systems, communications tools, analytics providers, CRM platforms, security vendors, document management providers, payment processors, and automation tools. Service Providers are contractually restricted from using personal information for purposes other than providing services to ContractorNerd or on our behalf, except where otherwise permitted by law.

SMS/Text Messaging Opt-In Data. Text messaging originator opt-in data and consent will not be shared with third parties for their own marketing or promotional purposes. We may share your mobile number and messaging data with service providers solely to deliver and administer text messages, and as required by law.

C. Affiliates

We may share information with our Affiliates for everyday business purposes, such as servicing accounts, operations, compliance, security, and internal administration, consistent with applicable law.

D. Legal and Regulatory Disclosures

We may disclose information to comply with applicable laws, regulations, subpoenas, court orders, lawful governmental requests, regulatory inquiries, state insurance regulator requests, and producer licensing obligations; to protect the rights, property, or safety of ContractorNerd, our customers, users, or the public; or to investigate, prevent, or address fraud, security incidents, or technical issues.

E. Business Transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be disclosed as part of that transaction, subject to appropriate confidentiality protections.

We may share information when you request us to share it or otherwise consent, such as with a lender, owner, contractor, certificate holder, additional insured, project partner, or authorized representative.

A. Marketing Preferences

You can opt out of marketing emails by using the unsubscribe link in the email. If you receive marketing texts, you can typically opt out by replying STOP or following the instructions provided in the message. You may still receive transactional or service messages related to quotes, applications, policies, renewals, billing, claims, or other service communications.

B. Cookies and Similar Technologies

You can manage cookies through your browser settings and, where available, through our cookie banner or preferences tool. Blocking cookies may affect site functionality.

C. Limiting Certain Disclosures

Depending on your relationship with us and applicable law, including insurance and financial privacy laws, you may have the right to limit certain disclosures of nonpublic personal information to nonaffiliated third parties outside of permitted exceptions. D. SMS/Text Messaging

If you provide your mobile number and opt in to receive text messages from us, we may send transactional and service-related texts, such as quote updates, policy servicing messages, reminders, and customer support messages. If you separately opt in to marketing texts where permitted, we may also send marketing messages.

Reply STOP to cancel. Reply HELP for help. Message frequency varies. Message and data rates may apply. Consent to receive text messages is not a condition of purchasing any goods or services. We do not share SMS opt-in consent with third parties for their own marketing or promotional purposes.

5. Tracking Technologies and Cookies

We use cookies and similar technologies, such as pixels, tags, scripts, and local storage, to operate our Services, remember preferences, measure performance, understand how our Services are used, improve user experience, and support security.

Types of cookies and similar technologies we may use include necessary or essential cookies required for site functionality, security, and core service operations; preference or functionality cookies that remember your settings and preferences; analytics cookies that help us understand usage, measure performance, troubleshoot issues, and improve the Services; and advertising cookies, if enabled, used to measure or deliver ads, attribute conversions, and help prevent fraud.

Analytics, Session Replay, and Heatmaps

We may use third-party analytics and behavioral tools, including Clicky, PostHog, Microsoft Clarity, Google Analytics, or similar providers where enabled, to understand how visitors and customers use our Services, measure performance, troubleshoot issues, and improve our Services and user experience.

These tools may collect information such as page views, clicks, scrolls, mouse movements, page navigation, referring and exit pages, time spent on pages, browser type, device information, IP address, approximate location derived from IP address, and similar usage or technical information.

Some tools may also provide session replay, session recording, heatmaps, and similar features that help us review how users interact with our Services. These features may capture page content, mouse movements, clicks, scrolling, page navigation, and certain form interactions during a session.

We configure session replay tools to mask certain sensitive form fields, including FEIN, SSN, EIN, tax ID, password fields, and other sensitive fields where reasonably feasible, and we use reasonable measures to avoid capturing those values in session recordings and heatmaps.

Cookie Choices

Most browsers let you remove or reject cookies and similar technologies through browser settings. Blocking or deleting cookies may affect site functionality or certain features of the Services.

Do Not Track and Opt-Out Preference Signals

Some browsers offer “Do Not Track” signals. Our Services may not respond to “Do Not Track” signals. Where required by law, we honor opt-out preference signals, such as browser-based signals, as requests to opt out of certain data uses such as sale or sharing for targeted advertising.

We retain analytics, session replay, and heatmap data only for as long as reasonably necessary to measure performance, troubleshoot issues, improve our Services, and satisfy legal or operational requirements. Retention periods may vary by provider, data type, and account settings.

7. Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no system is 100% secure. We cannot guarantee that information will never be accessed, disclosed, altered, or destroyed due to a breach of safeguards.

8. Artificial Intelligence

We may use AI, including generative AI, to support customer service, summarize or organize information, detect fraud, improve operations, and enhance user experience. We do not use AI to make final underwriting decisions for insurance carriers. When we use AI tools, we take steps designed to protect personal information and use appropriate controls and vendor safeguards.

9. External Links and Social Media

Our Services may contain links to third-party websites, including insurer, wholesaler, managing general underwriter, lender, payment processor, premium finance, and partner sites. We do not control and are not responsible for those third parties’ privacy practices.

If you interact with us through social media, any information you provide is governed by the social media platform’s privacy policy and your settings.

10. Children’s Privacy

The Services are not intended for children under 18. We do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, please contact us at [email protected] and we will take appropriate steps to delete it.

11. U.S. Privacy Rights, Including California

Certain U.S. state privacy laws provide residents with rights regarding their personal information. If you would like to exercise your rights, contact us using the information in Section 12.

California Notice at Collection

We may collect the categories of personal information described in Section 1, including identifiers, contact information, commercial information, internet or network activity, geolocation approximated from IP address, professional or employment-related information, financial or insurance-related information, and sensitive personal information where needed for insurance, verification, compliance, security, or related purposes.

We collect and use these categories for the business and commercial purposes described in Sections 2 and 3. We retain these categories as described in Section 6. We do not sell personal information as “leads.” If we engage in online advertising that may be considered “sharing” under California law, you may opt out as described below.

California Residents

If you are a California resident, you may have the right to request access to or information about the personal information we collected, used, disclosed, sold, or shared; request deletion of certain personal information, subject to exceptions; request correction of inaccurate personal information; opt out of sale or sharing of personal information where applicable; limit use and disclosure of sensitive personal information where applicable; and not be discriminated against for exercising privacy rights.

Shine the Light

We do not disclose personal information to third parties for their own direct marketing purposes without consent. Therefore, California’s “Shine the Light” law generally does not apply.
